為加強水(shui)利工(gong)程(cheng)建(jian)設質(zhi)量管理,提高質(zhi)量責任意識,強化質(zhi)量責任追(zhui)究(jiu),保證工(gong)程(cheng)建(jian)設質(zhi)量,省水(shui)利廳(ting)修訂(ding)了(le)《廣東省水(shui)利廳(ting)關于(yu)水(shui)利工(gong)程(cheng)建(jian)設質(zhi)量終身責任的(de)管理辦法》(以下簡稱《辦法》)。
一、《辦法》修訂的背景是什么?
(一)國(guo)家(jia)加強(qiang)工(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)管(guan)理(li)的要(yao)求。根據《建(jian)設(she)工(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)管(guan)理(li)條例(li)》《國(guo)務院辦公廳關(guan)于加強(qiang)基礎設(she)施(shi)工(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)管(guan)理(li)的通知(zhi)》《國(guo)務院辦公廳關(guan)于促(cu)進建(jian)筑(zhu)業持(chi)續(xu)健康發展(zhan)的意(yi)見》《水(shui)利工(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)管(guan)理(li)規定》《建(jian)筑(zhu)工(gong)(gong)程(cheng)(cheng)五(wu)方責(ze)(ze)任主(zhu)體項目(mu)負責(ze)(ze)人質(zhi)量(liang)(liang)終(zhong)身責(ze)(ze)任追究暫行辦法》,進一步嚴格落(luo)實水(shui)利工(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)終(zhong)身責(ze)(ze)任、提(ti)高質(zhi)量(liang)(liang)意(yi)識,強(qiang)化項目(mu)法人單(dan)位(wei)首要(yao)責(ze)(ze)任和勘察、設(she)計、監理(li)、施(shi)工(gong)(gong)等單(dan)位(wei)主(zhu)體責(ze)(ze)任。
(二)貫徹(che)水利(li)部(bu)文(wen)件的要求(qiu)。水利(li)部(bu)于水利(li)部(bu)2021年(nian)11月8日印發了《水利(li)工程責任單位(wei)責任人質量(liang)終身責任追究管理辦(ban)法(fa)(試行)》(水監督〔2021〕335號),規定(ding)各省、自治區、直轄市水行政主管部(bu)門可以根據本辦(ban)法(fa),制定(ding)實(shi)施細(xi)則。
(三)規(gui)(gui)范(fan)(fan)(fan)性文件管理(li)的要(yao)求。按照《廣(guang)(guang)東(dong)省(sheng)行政規(gui)(gui)范(fan)(fan)(fan)性文件管理(li)規(gui)(gui)定(ding)》(廣(guang)(guang)東(dong)省(sheng)人民政府令(ling)第277號(hao))規(gui)(gui)定(ding),規(gui)(gui)范(fan)(fan)(fan)性文件試(shi)行的有(you)效(xiao)期不得超過(guo)3年。《廣(guang)(guang)東(dong)省(sheng)水(shui)利廳關于(yu)水(shui)利工程建設(she)質量終身責任的管理(li)辦(ban)法(試(shi)行)》(粵水(shui)規(gui)(gui)范(fan)(fan)(fan)字(zi)〔2018〕1號(hao))于(yu)2018年12月1日起施行,有(you)效(xiao)期3年,于(yu)2021年12月1日已到期自動實效(xiao),亟需(xu)重新修訂(ding)。
二、《辦法》修訂的主要原則和內容是什么?
《辦(ban)(ban)法(fa)》的(de)(de)修訂遵守上(shang)位(wei)法(fa)規(gui)定(ding)(《建設(she)(she)工(gong)(gong)程(cheng)質(zhi)(zhi)量(liang)(liang)管(guan)理(li)條例》《水(shui)利(li)工(gong)(gong)程(cheng)建設(she)(she)質(zhi)(zhi)量(liang)(liang)管(guan)理(li)規(gui)定(ding)》《水(shui)利(li)工(gong)(gong)程(cheng)責(ze)(ze)(ze)任(ren)(ren)(ren)單(dan)位(wei)責(ze)(ze)(ze)任(ren)(ren)(ren)人(ren)(ren)質(zhi)(zhi)量(liang)(liang)終身(shen)責(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)究管(guan)理(li)辦(ban)(ban)法(fa)(試行)》《建筑(zhu)工(gong)(gong)程(cheng)五方責(ze)(ze)(ze)任(ren)(ren)(ren)主體(ti)項(xiang)目負責(ze)(ze)(ze)人(ren)(ren)質(zhi)(zhi)量(liang)(liang)終身(shen)責(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)究暫行辦(ban)(ban)法(fa)》等)。《辦(ban)(ban)法(fa)》的(de)(de)目的(de)(de)和思路明(ming)確,主要針對項(xiang)目法(fa)人(ren)(ren)、勘察、設(she)(she)計、施(shi)工(gong)(gong)、監理(li)單(dan)位(wei)5個質(zhi)(zhi)量(liang)(liang)責(ze)(ze)(ze)任(ren)(ren)(ren)主體(ti),規(gui)定(ding)了水(shui)利(li)工(gong)(gong)程(cheng)建設(she)(she)項(xiang)目承(cheng)擔(dan)質(zhi)(zhi)量(liang)(liang)終身(shen)責(ze)(ze)(ze)任(ren)(ren)(ren)的(de)(de)責(ze)(ze)(ze)任(ren)(ren)(ren)單(dan)位(wei)、責(ze)(ze)(ze)任(ren)(ren)(ren)人(ren)(ren),責(ze)(ze)(ze)任(ren)(ren)(ren)單(dan)位(wei)及其法(fa)定(ding)代表(biao)人(ren)(ren)、項(xiang)目負責(ze)(ze)(ze)人(ren)(ren)、直接(jie)責(ze)(ze)(ze)任(ren)(ren)(ren)人(ren)(ren)的(de)(de)責(ze)(ze)(ze)任(ren)(ren)(ren)及全省各級(ji)水(shui)行政主管(guan)部門(men)職責(ze)(ze)(ze),簡單(dan)明(ming)了,操(cao)作性強(qiang)。
《辦法(fa)》共(gong)20條。主(zhu)要內容如下:第(di)1—2條,規(gui)定(ding)(ding)(ding)(ding)了(le)(le)《辦法(fa)》制(zhi)(zhi)(zhi)定(ding)(ding)(ding)(ding)的依(yi)據和適用范圍。第(di)3—10條,規(gui)定(ding)(ding)(ding)(ding)了(le)(le)水(shui)(shui)利工程(cheng)建設項目承(cheng)(cheng)擔質(zhi)量終身責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)的責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)單(dan)位、責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)人(ren),責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)單(dan)位及其法(fa)定(ding)(ding)(ding)(ding)代表人(ren)、項目負(fu)責(ze)(ze)(ze)(ze)(ze)(ze)人(ren)、直接責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)人(ren)的責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)及全(quan)省(sheng)各級水(shui)(shui)行(xing)政主(zhu)管(guan)部門職責(ze)(ze)(ze)(ze)(ze)(ze)。第(di)11—15條,規(gui)定(ding)(ding)(ding)(ding)了(le)(le)項目負(fu)責(ze)(ze)(ze)(ze)(ze)(ze)人(ren)質(zhi)量終身責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)承(cheng)(cheng)諾(nuo)書(shu)(shu)簽署(shu)要求及管(guan)理,明確了(le)(le)設置質(zhi)量責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)公示(shi)牌、永(yong)久(jiu)性標牌、質(zhi)量終身責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)檔案管(guan)理制(zhi)(zhi)(zhi)度。第(di)16—19條,規(gui)定(ding)(ding)(ding)(ding)了(le)(le)質(zhi)量責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)究條件、責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)究、責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)處(chu)罰及信用懲戒。第(di)20條,規(gui)定(ding)(ding)(ding)(ding)了(le)(le)實施時限。附件包(bao)括承(cheng)(cheng)諾(nuo)書(shu)(shu)、授權書(shu)(shu)、責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)公示(shi)牌、永(yong)久(jiu)性責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)(ren)(ren)標牌制(zhi)(zhi)(zhi)作標準式(shi)樣。
三、《辦法》中對啟動質量終身責任追究的情形是如何規定的?
《辦法(fa)》規定,縣(xian)級以上人民政(zheng)府(fu)水行政(zheng)主管(guan)部門應當依(yi)法(fa)追究相關責(ze)(ze)任人的質量終身責(ze)(ze)任:
(一)發生(sheng)工(gong)程質量事故(gu);
(二)發生投訴、舉報(bao)(bao)、群體性事件、媒體負面報(bao)(bao)道等情形(xing),并造成惡劣社會影響(xiang)的(de)嚴重工程質量(liang)問題;
(三(san))由于勘察、設計或施工質量原因造成尚(shang)在合理使用(yong)(yong)年限內(nei)的水利(li)工程不能(neng)正(zheng)常使用(yong)(yong)或在洪水防御、抗震(zhen)等設計標準范圍內(nei)不能(neng)正(zheng)常發揮作用(yong)(yong);
(四)存在其他因質量(liang)原因需追(zhui)究責任(ren)的違法違規行為。
四、《辦法》中對水利工程質量終身責任制實施的保障措施,具體實行什么制度?
《辦法》中明(ming)確,我省水利工(gong)(gong)(gong)程(cheng)建設落實(shi)工(gong)(gong)(gong)程(cheng)質(zhi)量終身責任制,實(shi)行“一(yi)書(shu)兩牌”制度——開工(gong)(gong)(gong)前簽訂工(gong)(gong)(gong)程(cheng)質(zhi)量終身責任承(cheng)諾(nuo)書(shu)、在工(gong)(gong)(gong)程(cheng)施(shi)工(gong)(gong)(gong)現場明(ming)顯位置設立質(zhi)量責任公示(shi)牌、竣工(gong)(gong)(gong)后設置永久(jiu)性標牌,同時建立質(zhi)量終身責任檔案。
五、怎么保證《辦法》順利實施?
《辦法》中規定,省、市(shi)、縣水(shui)行政(zheng)主管(guan)部門(men)負責本級管(guan)轄(xia)范圍(wei)內的水(shui)利工程(cheng)(cheng)項(xiang)目(mu)責任單位責任人(ren)質(zhi)量終(zhong)身責任管(guan)理工作(zuo)進行指(zhi)導和監(jian)(jian)督(du)(du)管(guan)理。項(xiang)目(mu)負責人(ren)應當(dang)在辦理工程(cheng)(cheng)質(zhi)量監(jian)(jian)督(du)(du)手續(xu)前簽署工程(cheng)(cheng)質(zhi)量終(zhong)身責任承諾書(shu),連同法定代表人(ren)證(zheng)明材料,由建(jian)設單位(項(xiang)目(mu)法人(ren))報工程(cheng)(cheng)質(zhi)量監(jian)(jian)督(du)(du)機(ji)構備(bei)案。
六、在追究質量終身責任同時將怎樣實行信用懲戒?
各(ge)級(ji)水(shui)行政主管部門(men)應當在廣東(dong)省水(shui)利工程(cheng)建(jian)設信(xin)(xin)息管理系統公(gong)開(kai)所管轄的水(shui)利工程(cheng)項目負責人(ren)(ren)質(zhi)量終身責任承諾信(xin)(xin)息,及時(shi)在廣東(dong)省水(shui)利建(jian)設市場信(xin)(xin)用(yong)(yong)信(xin)(xin)息平臺公(gong)布責任單位責任人(ren)(ren)質(zhi)量責任追究情況,將其(qi)違法(fa)違規等不良行為及處罰結果記入個人(ren)(ren)信(xin)(xin)用(yong)(yong)檔案(an),實(shi)施信(xin)(xin)用(yong)(yong)懲戒。
七、下一步對抓好《辦法》的貫徹落實有何考慮?
為認真抓好(hao)《辦法》貫徹落(luo)實,將主要采取(qu)以下措施:
(一)加強(qiang)檢查(cha)督查(cha),將我(wo)省水(shui)利(li)工程質(zhi)量終身(shen)責(ze)任(ren)制的(de)落實(shi)情況(kuang)納入日常(chang)監督檢查(cha)重點內容(rong)。
(二)建(jian)(jian)設(she)廣東省(sheng)水(shui)利工(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)信息(xi)管理(li)系統(tong)(tong),督促各(ge)級水(shui)行政主管部門在廣東省(sheng)水(shui)利工(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)信息(xi)管理(li)系統(tong)(tong)公開所管轄的水(shui)利工(gong)(gong)(gong)程(cheng)項(xiang)目負責人質量終身責任承(cheng)諾(nuo)信息(xi);實現(xian)廣東省(sheng)水(shui)利工(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)信息(xi)管理(li)系統(tong)(tong)與(yu)廣東省(sheng)水(shui)利建(jian)(jian)設(she)市場信用信息(xi)平臺互(hu)聯(lian)互(hu)通,依托信息(xi)化手段加強管理(li)。
(三)加強信用(yong)監管,督促各級水行政主管部門及時在廣東(dong)省水利建設市場信用(yong)信息(xi)平臺公布責任單位、責任人質量(liang)責任追究、失信懲戒情況。
